This paper reviews the difficulties involved in the design and justification of complex digital systems and attempts to provide a basis for the demonstration of 'reasonable' (or unreasonable) design in a probabilistic way as associated with ALARP criteria. At present there are significant residual uncertainties in the processes involved and it is concluded that it would be sensible for engineers and scientists to work with the legal profession to develop a set of decision support tools which could facilitate a just legal framework.
